This section sets out the terms that apply to cancellations, changes, delays, and refunds for works carried out by Danlec Electrical Solutions Ltd (โDanlecโ, โweโ, โusโ, โourโ).
1. Formation of Contract
A contract is formed when the customer:
- Accepts a quotation or proposal (electronically or in writing), or
- Instructs Danlec to proceed with works
Once accepted, the quotation becomes a binding agreement subject to these Terms & Conditions.
2. Customer Cancellations โ Before Installation
2.1 Cancellation Within the Cooling-Off Period
Where applicable under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Customer has the right to cancel the Contract within 14 days of acceptance, without giving any reason.
If the Customer cancels within this cooling-off period, all payments received will be refunded in full unless the Customer has expressly requested that Danlec begins work during the cooling-off period.
Where work has commenced at the Customerโs request during the cooling-off period, Danlec may retain a proportionate amount reflecting the work carried out and costs reasonably incurred up to the point of cancellation.
The Customer must provide an express written request for work to commence during the cooling-off period and acknowledge that cancellation rights will be reduced accordingly.
The statutory right to cancel does not apply to goods made to the Customerโs specifications or clearly personalised once manufacture or procurement has commenced.
Where such goods have been ordered or procurement has commenced at the Customerโs request, the Customer shall remain liable for the cost of those goods.
2.2 Cancellation After the Cooling-Off Period
If the Customer cancelsย after the cooling-off periodย but before installation, Danlec reserves the right to retain or charge for costs incurred, including but not limited to:
- Survey and design work
- System design, drawings, and calculations
- Administrative time
- Materials ordered or allocated
- Supplier restocking charges
- Wasted labour or scheduling costs
Where costs incurred exceed any deposit paid, Danlec reserves the right to invoice the Customer for the balance of such costs.
2.3 Non-Refundable Costs
The following costs are non-refundable once incurred:
- Surveys (physical or remote)
- Design and engineering work
- Grid applications and notifications
- Bespoke or special-order materials
- Third-party fees
- Any work already carried out
This does not affect the Customerโs statutory rights during any applicable cooling-off period.
3. Cancellation After Work Has Started
If the Customer cancels after installation or on-site works have commenced:
The Customer shall be liable for:
- The full value of works completed,
- All materials supplied, ordered, or allocated,
- Any committed third-party or supplier costs,
- Reasonable demobilisation or reinstatement costs where applicable.
Danlec reserves the right to issue an invoice reflecting the above, which shall become immediately due and payable.
4. Changes to Scope of Works
4.1 Customer-Requested Changes
If the Customer requests changes to the agreed scope of works:
- Revised pricing may apply
- Additional labour or materials may be charged
- Installation dates may need to be rescheduled
All changes must be agreed in writing before implementation.
4.2 Variations Due to Site Conditions
If unforeseen site conditions are discovered (including but not limited to structural issues, cable routes, access restrictions, or non-compliant existing installations):
- Danlec will advise the customer
- Additional works may be required
- Revised costs may apply
If the customer declines necessary variations, Danlec may:
- Pause works
- Invoice for work completed
- Treat the instruction as a cancellation (see Section 3)
5. Installation Delays
5.1 Customer-Caused Delays
If installation is delayed due to:
- Lack of access
- Incomplete preparatory works
- Customer availability
- Late decisions or approvals
Danlec reserves the right to:
- Reschedule the installation
- Charge for wasted visits or labour
- Recover additional costs incurred
5.2 Delays Outside Our Control
Danlec is not liable for delays caused by:
- Weather conditions
- Supply chain issues
- Network operator delays
- Grid approval times
- Third-party failures
- Events beyond reasonable control
Such delays do not constitute grounds for cancellation, refund, or compensation.
6. Refunds
6.1 General Refund Policy
Refunds, where applicable:
- Are processed within a reasonable timeframe
- Will exclude non-refundable costs
- Will not include compensation for inconvenience or loss of use
6.2 No Refunds for Performance Expectations
Refunds will not be issued due to:
- Lower-than-expected savings
- Export payments differing from estimates
- Changes in tariffs, grants, or incentives
- Customer usage patterns
7. Deposits & Advance Payments
7.1 Purpose of Deposits
Where a deposit or advance payment is taken, it is used to secure installation dates, allocate resources, and cover preparatory work associated with the project, which may include (but is not limited to):
- Surveys and site assessments
- System design, drawings, and calculations
- Grid applications and DNO notifications
- Administrative and project management time
- Ordering or reserving materials
- Third-party fees or supplier commitments
7.2 Cooling-Off Period Rights
Where the contract is formed as a distance or off-premises contract, the Customer may have a statutory 14-day cooling-off period under the Consumer Contracts Regulations.
During the cooling-off period:
- Deposits are refundable unless the Customer has expressly requested that Danlec commences work within this period.
- Where the Customer requests early commencement, Danlec is entitled to retain a proportionate amount of the deposit to reflect work carried out and costs reasonably incurred up to the point of cancellation.
7.3 Non-Refundable Costs
Once costs have been incurred, whether during or after the cooling-off period, the corresponding portion of the deposit becomes non-refundable. This includes, but is not limited to:
- Completed surveys or design work
- Submitted grid or DNO applications
- Ordered or allocated materials
- Third-party charges already committed
7.4 Cancellations After the Cooling-Off Period
If the Customer cancels after the cooling-off period has expired, Danlec reserves the right to retain or invoice for all reasonable costs incurred up to the point of cancellation. Any remaining balance of the deposit, if applicable, will be refunded.
7.5 Application of Deposits
Deposits and advance payments:
- Are offset against the final contract price
- Do not constitute a penalty
- Are applied fairly and proportionately to costs incurred
7.6 Deposit Protection (Where Applicable)
Where required by scheme rules (including MCS and insurance-backed protection arrangements), deposit protection documentation will be issued following acceptance of the quotation and receipt of the deposit.
8. Termination by Danlec
8.1 Danlec reserves the right to cancel or suspend works if:
- Unsafe or non-compliant conditions are present
- The customer fails to cooperate or provide access
- Payment terms are breached
- Information provided is inaccurate or misleading
In such cases, Danlec may invoice for all work completed and costs incurred to date.
8.2 Failure to Proceed
Where the Customer fails to provide access, instructions, approvals, or cooperation necessary to proceed with the works for a period exceeding 30 days, Danlec may treat the Contract as cancelled by the Customer and invoice for all reasonable costs incurred to date.
9. Summary
In short:
- Accepted quotations are binding
- Design and preparatory work is chargeable
- Changes may affect cost and timing
- Refunds are limited to unused, unincurred costs
10. Statutory Rights
Nothing in these Terms affects the Customerโs statutory rights under UK consumer law, including rights under the Consumer Contracts Regulations and the Consumer Rights Act 2015.
